█ We represented a Fredericton City Police officer who was charged with summary conviction assault. The trial was one of the longest assault trials in New Brunswick including 14 days of testimony from 20+ witnesses. The police officer was successfully acquitted of the charge.

█ Lawyers with The Burke Law Group successfully represented an accused business man of drinking and driving. Our Defence lawyers argued our client's Canadian Charter of Rights and Freedoms were violated because he was denied his right to speak with his preferred lawyer of choice. The Certificate of a Qualified Breath Technician was refused admittance into evidence as a result of this breach of his rights and our client was found not guilty. The Crown had no proof of impaired driving.

█ We represented Metepenagiag First Nation, a small Mi'kmaq community in New Brunswick, in reaching a settlement agreement with the Federal Government of Canada, as a result of Canada’s wrongful taking of reserved land. The settlement was the largest in our Province and resolved hundreds of years of loss of use of traditional land to the Band members of this community.

█ Lawyers with The Burke Law Group appeared before the New Brunswick Labour and Employment Board to successfully argue one of the first cases involving New Brunswick's newly created labour legislation colloquially referred to as "double breasting." Our lawyers successfully demonstrated that a large Northern New Brunswick construction company was purposely avoiding it's bargaining rights by closing its operations and surreptitiously operating under another non-unionized construction company.

█ The Burke Law Group worked with the Mi'kmaq community of Elsipogtog First Nation to resolve its nationally recognized dispute with South Western Energy Corporation over its exploration techniques and usage of traditional Mi'kmaq territory in search of Shale Gas.

█ The Burke Law Group has worked with several First Responders suffering from Post Traumatic Stress Disorder and charged with Criminal Code offences. In these cases, we have been successful in ensuring our client’s mental health issues are addressed and they receive fair representation through the criminal courts system.

█ Lawyers with The Burke Law Group were successful in acquitting a client who was charged with a drinking and driving offence when they were sleeping behind the wheel of a parked car. Our Defence Lawyers argued that our client did not have the intention to drive the vehicle and was not capable of putting the vehicle into motion. As a result, the Court found our client not guilty.

█ The Burke Law Group has represented individuals who have been charged with Fraud and Forgery. In two separate cases, we have represented individuals who were charged with offences over $20,000 and $50,000. Lawyers from the Burke Law Group were successful in obtaining conditional sentences for both of these clients.

█ Lawyers with The Burke Law Group have represented many individuals who have been charged with theft from their employers. Most recently, we argued before the Court of Appeal of New Brunswick, seeking clarification on the law of sentencing in this area and were successful in convincing our Province’s highest court that our client’s term of imprisonment should be reduced.

█ Our lawyers successfully represented a local law enforcement official in a case involving an allegation of assault and breach of an undertaking. The officer was acquitted of the charge(s) before our court.
